It
is expected that any purchase is made in accordance
with our Terms and Conditions listed below |

The
Buyer agrees to purchase the Goods subject to
the following terms and conditions:

| 1. |
‘Buyer’
means the person who buys or agrees to buy the goods
from the Seller; |
| 2. |
‘Conditions’
means the terms and conditions of sale set out in
this document and any special terms and conditions
agreed in writing by the Seller |
| 3. |
‘Delivery
Date’ means the date specified by the Seller
when the goods are to be delivered |
| 4. |
‘Goods’
means the articles which the Buyer agrees to buy
from the Seller. All goods are subject to availability.
If the Seller cannot fulfil the order, it will offer
the Buyer an alternative or where an alternative
is not accepted by the Buyer and payment has been
made give a full refund. |
| 5. |
‘Price’
means the price for the Goods excluding carriage
and packing |
| 6. |
‘Seller’
means Western Winner Show Clothes Limited, Registered
Office: John Hill Partnership, Fairstow Chambers,
Library Road, Ferndown, Dorset BH22 9JW |
| 7. |
These
Conditions shall apply to all contracts for the
sale of Goods by the Seller to the Buyer to the
exclusion of all other terms and conditions including
any terms or conditions which the Buyer may purport
to apply under any purchase order, confirmation
of order or similar document. |
| 8. |
All
enquiries for Goods shall be deemed to be an offer
by the Buyer to purchase Goods pursuant to these
Conditions. |
| 9. |
Acceptance
of delivery of the Goods shall be deemed conclusive
evidence of the Buyer’s acceptance of these
Conditions. |
| 10. |
Any
variation to these Conditions (including any special
terms and conditions agreed between the parties)
shall be inapplicable unless agreed in writing by
the Seller. |
| 11. |
The
Total Amount Payable shall be the Seller’s
quoted Total Amount Payable and payable in sterling.
The Seller reserves the right to change any advertised
prices at any time. |
| 12. |
Payment
of the Total Amount Payable shall be due from the
Buyer at the time of ordering the Goods. Payment
by the Buyer shall be by cheque sent to the Seller’s
trading address or bank transfer. Time for payment
should be within 7 days of the date of the proforma
invoice. No goods will be made for the Buyer until
payment for the goods has been cleared. |
| 13. |
The
Seller will endeavour to take all reasonable steps
and care, in so far as is possible to ensure that
the Buyer’s details of order and payment are
secure. In the absence of negligence on the part
of the Seller, the Seller cannot be held liable
for any loss suffered by the Buyer if a third party
procures unauthorised access to any data provided
to the Seller at the time of accessing or ordering. |
| 14. |
The
quantity and description of the Goods shall be as
set out in the Seller’s Proforma Invoice.
The Seller warrants that the Goods supplied will
at the time of delivery correspond to the description
given by the Seller. |
| 15. |
Delivery
- we send all items by Royal Mail Special Delivery,
a signature is required on receipt. |
| 16. |
Returns
– Custom made items may not be returned unless
faulty, and any items should be returned within
7 working days in mint condition with all packaging
and tags intact using Royal Mail Special Delivery |
